Kerrsplat Copyright and Licensing

These Copyright and Licensing Terms apply to publications released under Kerrsplat Publishing, an imprint of Integrated Desktop Solutions, Inc.

These terms supplement the general legal provisions established at www.billmcnamee.com/legal and provide additional information concerning the ownership, purchase, licensing, and permitted use of Kerrsplat Publishing publications.

Where publication-specific terms differ from the general website provisions, the publication-specific terms govern the use of the applicable publication, subject to applicable law.

Copyright and Ownership

Unless otherwise indicated, publications released under Kerrsplat Publishing are protected by applicable United States and international copyright laws.

Copyright ownership remains with the identified author, photographer, artist, or other rights holder. Kerrsplat Publishing operates as an imprint of Integrated Desktop Solutions, Inc. and does not constitute a separate legal entity.

The purchase or acquisition of a publication, whether physical or digital, does not transfer copyright ownership or intellectual property rights to the purchaser.

General Rights and Restrictions

All rights are reserved unless expressly stated otherwise.

Unless otherwise specified, the lawful purchaser of a Kerrsplat Publishing digital publication receives a limited, nonexclusive, nontransferable license for personal, noncommercial use.

This license permits the purchaser to:

• Download and retain the purchased digital publication.

• Read and view the publication on multiple personally owned or controlled devices.

• Create reasonable backup copies for personal preservation.

• Retain and access the publication indefinitely, subject to compliance with the applicable license and any limitations imposed by law.

The purchase of a digital publication does not transfer copyright ownership.

Digital Publication Restrictions

Unless expressly authorized or permitted by applicable law, digital publications may not be:

• Printed, reproduced, or converted into physical copies.

• Resold, redistributed, shared, transferred, or sublicensed to another person.

• Uploaded to public websites, file-sharing services, or other distribution platforms.

• Separated into individual photographs, illustrations, or other components for independent use or distribution.

• Modified, adapted, or incorporated into derivative works for redistribution or commercial exploitation.

• Distributed with copyright notices, attribution, or licensing information removed or altered.

These restrictions do not prohibit uses that applicable law expressly permits.

Artificial Intelligence and Automated Content Use

Except as authorized by the applicable rights holder or permitted by law, Kerrsplat Publishing publications and their contents may not be used for:

• Training, fine-tuning, or developing artificial intelligence or machine-learning models.

• Creating or contributing to datasets intended for automated content generation or model development.

• Systematic extraction, reproduction, or redistribution of text, photographs, illustrations, or other protected material.

• Automated commercial exploitation of publication contents without authorization.

Nothing in this section is intended to restrict lawful accessibility functions, ordinary personal reading tools, or uses protected by applicable law.

Educational, Institutional, and Commercial Use

Educational institutions, libraries, businesses, organizations, and other parties seeking to reproduce, distribute, publicly display, or otherwise use publication contents beyond the permissions granted by applicable law or an individual publication license should request authorization.

Permissions may be granted for specific educational, institutional, editorial, or commercial purposes at the discretion of the applicable rights holder.

Refunds and Digital Purchases

Due to the nature of downloadable digital publications, digital purchases are generally considered nonreturnable once the purchased files have been delivered or made available for download.

Refunds, replacements, or other remedies may be provided where required by applicable law, where a publication is defective or materially misrepresented, or at the discretion of the seller.

Purchases completed through third-party marketplaces or distribution platforms may also be subject to the applicable platform's refund and purchase policies.

Nothing in this section limits mandatory consumer rights or remedies established by law.

License Duration and Termination

A digital publication license is intended to remain valid indefinitely for the original purchaser, provided the purchaser complies with its terms.

A license may be terminated following a material violation of its conditions, subject to applicable law.

Termination does not affect rights or remedies that cannot lawfully be excluded.

Notice of Liability

Kerrsplat Publishing makes reasonable efforts to ensure the accuracy, quality, and completeness of its publications.

However, publications may contain errors, omissions, historical interpretations, personal opinions, or information that changes over time.

Unless expressly stated otherwise, publications are provided without guarantees concerning the accuracy, completeness, currency, or suitability of their contents for any particular purpose.

To the extent permitted by applicable law, Bill McNamee and Integrated Desktop Solutions, Inc. disclaim liability for losses or damages arising from reliance upon or use of publication contents.

Nothing in this notice excludes liability that cannot legally be limited or excluded.
